These terms govern your use of the KALA Supply Design website. By using the site you agree to them. If you do not agree, please do not use the site.
This site is not the contract
This is a marketing site. Nothing here is an offer to enter a contract, and using it does not create a rental agreement or a fabrication agreement between us. Any actual booking is governed by the separate written agreement we sign with you, which covers pricing, deposits, delivery, installation, damage, cancellation, and insurance. Where that agreement and these terms disagree, that agreement wins.
Estimates and availability
Prices, lead times, dimensions, finishes, and availability shown on this site or produced by the estimate tool are indicative and subject to change. An estimate is not a quote and not a reservation. Inventory is not held until we confirm it in writing, and custom fabrication is priced only after we understand the scope. No payment is taken on this site.
The on-site assistant
The chat assistant is generated by an AI model and can be wrong, incomplete, or out of date. Nothing it says is a quote, a reservation, professional advice, or a commitment by KALA, and it does not bind us. Confirm anything that matters with us directly. What the assistant does with your messages is described in our Privacy Policy.
What you send us
When you submit reference images, drawings, or other material with an inquiry, you confirm you have the right to share it and you give us permission to use it for the limited purpose of reviewing, quoting, and producing your project. Do not send material you are not free to share. We are not responsible for material you send us in breach of someone else's rights.
Acceptable use
Use this site for legitimate business inquiries. You agree not to scrape, mirror, or bulk-extract its content through automated means without written permission, not to misuse the assistant or the inquiry forms, and not to interfere with the site's operation or security.
Intellectual property
The photography, project imagery, designs, text, and layout of this site belong to KALA Supply Design or are used with permission, and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from them without our written permission.
Limitation of liability
This site is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, KALA Supply Design and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits or lost opportunity, arising out of or relating to your use of this site, including reliance on an estimate, a specification, or anything the assistant said. This section is about the website. Liability connected to work we actually perform is addressed in the signed agreement for that work.
Indemnification
You agree to indemnify, defend, and hold harmless KALA Supply Design and its operators from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of this site, the material you submit through it, your violation of these terms, or your violation of any law or the rights of a third party.
Governing law
These terms are governed by and construed in accordance with the laws of the State of Florida, USA, without regard to its conflict of law provisions. Any dispute arising out of or relating to these terms or your use of this site will be resolved exclusively in the state or federal courts located in Broward County, Florida, and you consent to personal jurisdiction and venue in those courts.
How This Site Is Produced
We use AI tools to help research, draft, and maintain parts of this site, including product summaries, comparison notes, and articles. A person reviews what gets published and we fix errors when we find them, but AI-assisted content can still be wrong or out of date. Always confirm the details that matter on the retailer's own listing before you buy.
We do not publish AI-generated reviews or testimonials, we do not present our own editorial judgments as customer review data, and we do not display star ratings we did not receive from a real review source.
Content You Submit
If you send us anything, including an email, a correction, or a price report, you confirm you have the right to share it and you grant us a non-exclusive, royalty-free licence to use it to operate and improve the site. Do not send confidential material or anything you are not free to share.
We may remove or decline to publish anything sent to us, for any reason. If you believe something here infringes your copyright, contact us with the page, a description of the work, and your contact details, and we will review and remove infringing material.
Binding Arbitration and Class Action Waiver
Please read this section carefully. It affects how disputes between us are resolved and limits the ways you can seek relief.
You and KALA Supply Design agree that any dispute arising out of or relating to these terms or your use of the site will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitrator's award is final and may be entered as a judgment in any court with jurisdiction.
You and KALA Supply Design each waive the right to a jury trial and the right to bring or take part in a class, collective, consolidated, or representative action. The arbitrator may not combine more than one person's claims and may award relief only to the individual seeking it.
Exceptions. Either of us may bring an individual claim in small claims court, and either of us may ask a court for an injunction to protect intellectual property rights.
You can opt out. Email hello@kalaeventsupply.com within 30 days of first using the site, with your name and a statement that you decline arbitration. Opting out costs you nothing and changes nothing else in these terms.
If the class action waiver above is found unenforceable, this entire arbitration section does not apply and disputes will be resolved in the courts named under Governing Law.
Changes
We may update these terms at any time. Changes are posted on this page with a new date above. Continuing to use the site means you accept the updated terms.
